It all begins with the American code of justice that states “Innocent until proven guilty”.
While a trial often seems an unnecessary action and defending an obvious rapist/criminal sometimes appears unfair to the victims, our American code of justice and fairness mandates that we present the facts publicly before a jury of 12 upstanding citizens in an effort to determine guilt or innocence.
To maintain this code of fair and just treatment, the accused must have the benefit of an attorney who is bound by law and his oath to defend his client to the best of his ability.
Is this fair to society or the victims? Maybe not. But without this code of justice, think what the lack of it would be like!
The purpose of an attorney is to make sure your Constitutional rights are not violated
Even criminals have rights.
If an attorney does not adequately represent his client, they can appeal, and the conviction can be vacated. That is a waste of time and money, and gives the suspect another chance to get off.
Everyone accused of a crime has a right to face their accuser in court and defend themself, with an attorney. Our legal system requires this to avoid putting innocent people in jail.
His attorney will try to prove him innocent. The prosecution will attempt to show he is guilty. Both sides are given the opportunity to prove their version of events, and a judge or jury will determine his guilt based on the evidence they have seen.
